10525 of 2023 ORDER: This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief: “to issue a writ order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the Respondents in not regularizing the period of suspension of the petitioner from 26.11.2012 to 24.07.2013, inspite of the orders of APAT in O.ANo.1707/2018 dated 23.08.2018, as illegal, unjust, arbitrary, and violative of Articles 14 & 16 of the Constitution of India and consequently direct the respondents to regularize the suspension period of the petitioner from 26.11.2012 to 24.07.2013, as per the orders of APAT in O.A No.1707/2018 dated 23.08.2013 and also in accordance with FR.54(b) of the Fundamental Rules, with all service and monetary benefits and pass such other order or orders.” 2.

Heard learned counsel for the petitioner and learned Government Pleader for the respondents.

Learned counsel for the petitioner submits that suffice if a direction is given to respondents, more particularly to the 1st respondent, to consider the representation dated 07.09.2020 submitted by the petitioner to the 1st respondent.

Learned Government Pleader appearing for the respondents would submit that the representation dated 07.09.2020 submitted by the petitioner would be considered by 2 the 1st respondent in accordance with law, within a reasonable time.

Having regard to the submissions made by learned counsel for the petitioner and learned Government Pleader for the respondents, in view of the facts and circumstances of the case, without touching merits of the case, this Court is of the considered view that the present Writ Petition can be disposed of directing the 1st respondent to consider and dispose of the petitioner’s representation dated 07.09. ted 07.09.2020 and pass appropriate orders within a period of six (06) weeks from the date of receipt of a copy of this order.

With the above said direction, the Writ Petition is disposed of.

There shall be no order as to costs.
