THE HON’BLE SRI JUSTICE RAVI CHEEMALAPATI WRIT PETITION NO.10232 OF 2023 ORDER: The present Writ Petition is filed by the petitioners under Article 226 of the Constitution of India, seeking the following relief: “. . . . . pleased to issue a writ, order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of the Respondents in not releasing the funds amounting of Rs.1,80,000/- to the petitioners in relation to the Scheme i.e., Construction of Houses under YSR Rural housing is Questioned as the same is illegal, arbitrary and violation of Principals of Natural Justice and Un Constitutional and consequently direct the respondents to release funds amounting of Rs.1,80,000/ to the petitioners in respect of construction of Houses under YSR housing Scheme forthwith and pass.....” 2.

Learned Assistant Government Pleader for Finance & Planning representing Respondent No.2 and Sri E.V.

State Housing Corporation, representing Respondent Nos.4 to 6, collectively submitted that, the authorities have admitted the bill amount of the petitioners and they would pay in 2 due course.

They also submitted that, in similar set of facts this Court passed Order dated 28.06.2022 in W.P.No.17411 of 2022 wherein granted six (06) weeks’ time for payment and accordingly, prayed to consider in the same lines.

To the said submission, learned counsel for the petitioners reported no objection.

Taking into consideration the submissions of both the learned counsel, this Writ Petition is also disposed of, at the admission stage, in terms of the orders passed in W.P.No.17411 of 2022, dated 28.01.2022.

Accordingly, the respondents are directed to release the admitted/legally entitled amount to the petitioners at the earliest, and at any rate, within a period of six (06) weeks from the date of receipt of a copy of this order.

With regard to interest is concerned the petitioners are at liberty to approach appropriate forum.

There shall be no orders as to costs.
