SREENIVASA REDDY CRIMINAL PETITION NO.2999 of 2023 ORDER: This Criminal Petition, under Sections 437 and 439 of Cr.P.C., has been filed by the petitioner/A-3, seeking regular bail, in Crime No.119 of 2023 of Amalapuram Town Police Station, Dr.B.R.Ambedkar Konaseema District.

A case has been registered against the petitioner herein and others for the offences punishable under Sections 8(c) read with 27(b)(ii)(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short ‘the NDPS Act’).

The case of the prosecution is that on 05.03.2023 at about 13.15 hrs, at Coconut farm of Kolaganti Tatarao @ Tataji, Savaram By-pass Road, Amalapuram Town, on receipt of credible information regarding illegal transportation of contraband, the SDPO, Amalapuram Sub Division while conducting raid arrested A1 to A7 when they were found transporting 7 bags of Ganja, total weighing 21 Kgs of Ganja from all accused and while sharing the Ganja among them and seized 7 school bags having Ganja and six cell phones from the possession of the accused 1 to 4 and accused 6 and 7 and seized the contraband under a cover of mediators report and arrested them and sent to judicial custody on 06.03.2023.

The petitioner herein was arrested on 06.03.2023 and since then, he is languishing in jail.

The quantity of contraband has been seized by the police is about 21 Kgs.

It is represented by the learned Assistant Public Prosecutor that the major portion of the investigation is completed.

As among as 10 witnesses were examined.

For want of RFSL report, the Police is not yet filed Charge Sheet.

In view of the aforesaid facts and circumstances of the case, this Court is inclined to grant bail to the petitioner herein, on the following conditions. (i) The petitioner herein shall be released on bail on his executing a personal bond for Rs. nd for Rs.10,000/- (Rupees Ten Thousand only) with two sureties for a like sum each to the satisfaction of the learned I Additional District and Sessions Judge, East Godavari District at Rajamahendravaram. (ii) On release, the petitioner shall appear before the concerned Station House Officer once in a week i.e., on every Friday between 10.00 a.m. and 01.00 p.m., till filing of the charge sheet.
