SREENIVASA REDDY Criminal Petition No.2774 of 2023 Order: This Criminal Petition, under Section 437 & 439 of Cr.P.C., has been filed by the petitioner/A6, seeking bail, in connection with Crime No.34 of 2023 of Malkipuram Police Station, Dr.B.R.Ambedkar Konaseema District.

A case has been registered against the petitioner and others for the offence punishable under Section 8(c) r/w 27(a) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short ‘the NDPS Act’).

Case of the prosecution, in brief, is that on 07.03.2023 at 06.30AM, on reliable information, SI of Police, Malkipuram Police Station, Dr.B.R.Ambedkar Konaseema District, along with his staff and mediators conducted raid at Vasista Godavari Bridge from Dindi to Chchinada, opposite to Pothareddy coconut garden at Dindi Village and noticed A1 to A5 in possession of 22 kgs and 200 grams of Ganja.

On questioning, A1 to A5 stated that A6 and A7 are supplying the said Ganja.

The contraband and other material was seized under a cover of mediators 2 report.

The petitioner was arrested and remanded to judicial custody on 11.03.2023.

Perused the record.

A perusal of material on record goes to show that, the petitioner was arrested on 11.03.2023.

Learned Special Assistant Public Prosecutor also submits that investigation is pending and some more witnesses are to be examined.

In view of the aforesaid facts and circumstances of the case, investigation is still at nascent stage. this Court is not inclined to grant anticipatory bail to the petitioner.

Accordingly, the Criminal Petition is dismissed.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Criminal Petition, shall stand closed. _____________________ K.
