THE HON’BLE SRI JUSTICE RAVI CHEEMALAPATI WRIT PETITION NO.9761 OF 2023 ORDER: This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief: “issue a appropriate writ order or orders more particularly one in the nature of WRIT OF MANDAMUS declaring the action of the respondents in not releasing the balance amounts of Rs.

68,65, 510/- (Rupees Sixty Eight lakhs Sixty Five thousands Five hundred and Ten only) excluding GST at 18 percent with interest at 24 percent per annum as per the Memo No PHC/DandP/Con/421/0304/01 dated 27032019 and Agreement Bond No MD/LS/DandP/30/201920 dated 27.05.2019 is illegal arbitrary and violative of the principles of natural justice and violative of article 14, 15 and 21 of the constitution of India and consequently direct the respondents to settle the accounts of the petitioner…...” 2.

Heard learned counsel for the petitioner, Sri K.C.Venkata Reddy, learned Standing Counsel for APSPH appearing for respondent Nos.1 to 5, learned Government Pleader for Social Welfare appearing for respondent No.6 and learned Government Pleader for Finance Department appearing for respondent No.7.

Sri K.C.Venkata Reddy, learned Standing Counsel for APSPH appearing for respondent Nos.1 to 5, learned Government Pleader for Social Welfare appearing for respondent No.6 and learned Government Pleader for Finance Department appearing for respondent No.7, on written instructions, collectively submits that, the authorities have admitted to pay the bill amount of the petitioner in due course to the petitioner.

They also submitted that, in similar set of facts this Court passed Order dated 28.06.2022 in W.P.

No.17411 of 2022 thereby granted six (06) weeks time and in the same lines, this case also be considered.

To the said submission, learned counsel for the petitioner reported no objection.

Taking into consideration the submissions of both the learned counsel for the petitioner as well as learned counsel for the respondents, this Writ Petition is disposed of, at the admission stage, in terms of the orders passed in W.P.

No.17411 of 2022 dated 28.06.2022.

Accordingly, the present Writ Petition is disposed of directing the respondents to release the legally entitled amount to the petitioner, at the earliest and at any rate, within a period 3 of six (06) weeks from the date of receipt of a copy of this order.

It would be open to the petitioner to agitate his claim for interest, if any, payable by the respondents, if he is so advised, in an appropriate forum.

There shall be no order as to costs.
