THE HONOURABLE SRI JUSTICE D.RAMESH WRIT PETITION No.9390 of 2023 ORDER: This Writ Petition under Article 226 of the Constitution of India is filed for the following relief:- “..to issue a Writ, Order or direction preferably writ of mandamus declaring the order issued by the 3rd respondent vide Roc.G/640/2023 dated 03.04.2023 suspending the petitioner’s authorization in respect of the FP Shop No.
1047002, Arimakulapalli Village, SR Puram Mandal (Sri Rangaraja Puram) Chittoor District, without assigning any valid reasons and without following the procedure as contemplated under AP State Targeted Public Distribution System (Control) Order, 2018 is illegal, arbitrary, and volatile of principles of natural justice and consequently set aside the order dt: 03.04.2023 by directing the respondents to release Essential Commodities in favour of the petitioner as usual and pass any other order this Hon’ble may deem fit in the interest of justice….””.
Heard the learned counsel for the petitioner and the learned Government Pleader appearing for the respondents.
Learned counsel for the petitioner has submitted that the 4th respondent has submitted his report to the 3rd 2 respondent on 29.03.2023 stating that the petitioner is working as private college principal in SV Degree College, Kothapalli Mitra, SR Puram Mandal from 04.06.2008.
Basing on the alleged report, the impugned order was passed on 03.04.2023 suspending the authorization of the petitioner.
Learned counsel for the petitioner further submits that the petitioner has submitted his resignation on 20.02.2023 to the school management, the same was accepted and he was relieved from the institution on 24.02.2023.
In view of the submissions of the learned counsel for the petitioner, the respondents are directed to consider the said aspect i.e., resignation submitted by the petitioner on 20.02.2023, conclude the enquiry as expeditiously as possible and take appropriate action in the matter. he matter.
With the above directions, this Writ Petition is disposed of.
No costs.
