1 THE HON’BLE SRI JUSTICE RAVI CHEEMALAPATI WRIT PETITION No.9183 of 2023 ORDER: This Writ Petition is filed by the petitioner, under Article 226 of the Constitution of India, seeking the following relief: “to issue an appropriate writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the impugned proceedings of the 2nd respondent vide proceedings No.P1/E5/259(28)/2016-RMT dated 04.04.2023, in not considering the request of the petitioner for issuance of clearance certificate in respect of petitioner’s bus bearing registration No.AP03 TE 2604 as highly arbitrary, illegal and contrary to law and consequently direct the respondent herein to issue clearance certificate in respect of said bus by accepting undertaking furnished by petitioner forthwith in the interest of justice and to pass such other order or orders….” 2.

Today, when the matter is taken up for consideration, it is brought to the notice of this Court by Sri E.Maruthi Raja, learned counsel for the petitioner as well as Sri K.Viswanatham, learned standing counsel for APSRTC appearing for respondent Nos.1 to 3 that the issue involved in this Writ Petition is squarely covered by the order of this Court in Writ Petition No.38417 of 2022 dated 28.11.2022, which is placed on record and prayed to pass order on same lines.

Following the above said order and for the reasons recorded therein, this Writ Petition also stands disposed of in terms of the said order. “Having regard to the submissions made by both the learned counsel, respondent No.2 is hereby directed to issue No Objection Certificate in favour of the petitioner in respect of the Hire bus bearing registration No.AP 03 TE 2604 on his furnishing an undertaking in favour of the respondent corporation from its claim of non-liability, within two (2) weeks from the date of receipt of a copy of this order.” 4.

Accordingly, the Writ Petition is disposed of.

There shall be no order as to costs. to costs.
