2173 of 2023 ORDER: The writ petition is filed under Article 226 of the Constitution of India for the following relief: “...o issue a Writ or Order more in the nature of Mandamus, to declare the action of the respondents in recovering the amount of Rs.3,53,298/- (Rupees Three Lakh Fifty Three Thousands Two Ninety Eight only) already paid as illegal, arbitrary, unjust, and consequentially direct the respondents to refund the recovered amount of Rs.3,53,298/- (Rupees Three Lakh Fifty Three Thousands Two Ninety Eight only) by extending the benefit of the Judgments in W.P.Nos.21849 of 2012, 21830 of 2012 and 21858 of 2012 by judgment dated 30.09.2021, W.P.No.22871 of 2013 and W.P.No.10495 of 2015 judgment dated 10.02.2021 by DB, W.P.No.15186 of 2021 judgment dated 03.08.2021 by DB, W.P.No.31507, 31491, 31496 of 2013 dated 18.01.2021 by DB, W.P.No.33315 of 2013 dated 22.06.2020 by DB and the pension be refixed on the last pay drawn by the petitioner as done to similar employees vide proceedings dated 26.04.2021, pass such other orders order.” (in verbatim) 2.

Heard learned counsel for the petitioner, learned Government Pleader for Services-III appearing for respondent Nos.1 to 3, learned standing counsel for the 4th respondent- ZPHS Girls School and learned standing counsel for the 5th respondent.

When the matter is taken up for hearing, learned counsel for the petitioner would submit that the issue involved in this 2 Writ Petition is squarely covered by the order dated 22.06.2020 passed by the Division Bench of this Court in Writ Petition No.33315 of 2013 and requested to pass a similar order in this writ petition also.

The same is not disputed by learned Government Pleader for Services-III appearing for respondent Nos.1 to 3.

In view of the same, for the reasons alike in the aforesaid order, this Writ Petition is also disposed of in terms of the order dated 22.06. ted 22.06.2020 passed by the Division Bench of this Court in Writ Petition No.33315 of 2013.

There shall be no order as to costs.

Registry is directed to attach a copy of the order dated 22.06.2020 passed by the Division Bench of this Court in Writ Petition No.33315 of 2013 to this order.
