6778 of 2023 ORDER: This writ petition is filed by the petitioners under Article 226 of the Constitution of India for the following reliefs: “...to issue an appropriate writ, order or direction, more particularly one in the nature of Mandamus, declaring the 2nd respondent in continuing the petitioner’s suspension as per proceedings No.ACB/A1/2022 dated 21.05.2022 in pursuance to the Crime No.01/RCT-KDP/2022, dated 17.05.2022 without considering the representations of the petitioners dated 13.10.2022 in gross violation of principles of natural justice and procedural established by law as being illegal, arbitrary and violation of Articles 14, 19 and 21 of Constitution of India and consequently direct the respondents to reinstate the petitioner into service and pass such other order or orders as are deemed fit and proper..” (in verbatim).

Heard learned counsel for the petitioners and learned Government Pleader for the respondents.

When the matter is taken up for hearing, learned counsel for the petitioner mainly submits that the respondents may be directed to dispose of the representation dated 13.10.2022 filed by the 2 NV,J W.P.No.6778 of 2023 petitioner seeking reinstatement into service, for which learned Government Pleader for the respondents has expressed no objection.

Having regard to the submissions made by both the learned counsels and in the facts and circumstances of the case, without going into the merits of the case, the Writ Petition is disposed of with a direction to the respondents to consider the representation of the petitioner dated 13.10.2022 and pass orders within a period of six weeks from the date of receipt of a copy of this order, after providing an opportunity of hearing to the petitioner.
No order as to costs.
