1 HON’BLE SRI JUSTICE G.NARENDAR AND HON’BLE SRI JUSTICE HARINATH N WRIT APPEAL NOs.
226 and 227 of 2023 COMMON JUDGMENT:- (per Hon’ble Sri Justice G.Narendar) 1.
Learned counsel for the Writ Appellant, in W.A.No.226 of 2023, prays for time.
2.
We have heard the learned counsel for the Appellant in W.A.No.227 of 2023.
3.
Both the Appeals arise out of similar orders in W.P.
Nos.
29713 of 2021 and 2608 of 2022.
4.
The short ground that canvassed before this Court is that when the matter is heard, this Court by an order, dated 07.09.2022, had observed that orders were reserved so-far-as the maintainability of the Writ Petitions is concerned, but when the orders in Writ Petitions were pronounced, it is found that the orders addressed the case on entire merit itself.
We are of the opinion that, it would be the interest of the parties to approach the learned Single Judge for review of the judgment and while 2 so, being this Court is also conscious of the opinion that limitation should not later act as a bar.
5.
In that view, the Writ Appeals are disposed of reserving liberty to the appellants to approach the learned Single Judge by way of review petition and in the event the appellants are in any manner aggrieved, it is open for them to re-file the appeal on the same cause of action.
6.
It is pertinent to observe that any Interim relief granted in the Writ Petitions shall be in force for a period of only 15 days from today.
7.
Accordingly, the Writ Appeals are disposed of.
There shall be no order as to costs.
As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Appeals shall stand closed. ________________ G.NARENDAR, J _________________ HARINATH N, J 27.03.2024 PKR 3 HON’BLE SRI JUSTICE G.NARENDAR AND HON’BLE SRI JUSTICE HARINATH N 131 WRIT APPEAL NOs.
