MALLIKARJUNA RAO Writ Petition No.9139 of 2023 ORDER: (Per UDPR, J) Heard learned counsel for the petitioner, Sri C.
Sanjeeva Rao, and learned Government Pleader for Commercial Taxes for the respondents.
Admittedly, the Appeal, TA.No.39 of 2022, preferred by the petitioner against the appellate order in A.O.No.ZH370921OD90175, dated 09.09.2021, is pending before the VAT Appellate Tribunal, Visakhapatnam.
The petitioner has already deposited 50% of the disputed tax.
In that view of the matter, this Writ Petition is allowed and there shall be stay of collection of the balance of 50% of the differential tax till disposal of the Appeal, TA.No.39 of 2022, by the VAT Appellate Tribunal, Visakhapatnam.
No costs.
As a sequel, interlocutory applications pending, if any, in this case shall stand closed. __________________________ U.
