Since the issue involved in all these writ petitions is one and the same, they are being heard together.

The writ petitions in W.P.

Nos.

W.P.

Nos.8141, 8144 and 26260 of 2023 are filed by the claimants of the TDR bonds, which are due to be issued to them in lieu of taking over their respective lands situated in Mamidalapadu Village, Stantannapuram Panchayat, Kurnool Mandal, Kurnool District, for expansion of the highway.

The claim of the petitioners in W.P.

No.2431 of 2023 and W.P.

No.16070 of 2023 is that they were issued notices informing them of the requirement of their respective lands situated in Mamidalapadu Village, Kurnool Urban Mandal, Kurnool District, for road widening purposes and were duly informed of their entitlement to TDR bonds.

Insofar as W.P.

No.2431 of 2023 is concerned, the learned counsel for the petitioners submits that this Court directed the respondents -4- W.P.

Nos.2431 AND 16070 of 2023 Date of order:17.11.2025 not to lay a road without following due process of law.

In pursuance of the order, the respondents have released the TDRs.

As such, it is submitted that the cause in the writ petition does not survive.

Recording the same, W.P.

No.2431 of 2023 is closed.

Insofar as the respective claims in W.P.

Nos.8141, 8144, 26260 and 16070 of 2023 are concerned, the learned standing counsel for the Municipal Corporation submits that the petitioners and the unofficial respondents have filed O.S.

No.601 of 2025 on the file of the Principal Civil Judge (Junior Division), Kurnool, and O.S.

No.656 of 2025 on the file of the III Additional Civil Judge (Junior Division) seeking declaration of their respective titles over the subject land.

The entitlement of TDR bonds would be subject to title determination.

The parties claiming the TDR bonds and the title for the property over which the respondents have laid a road would have to be ascertained before the trial court in the pending suits.

Considering the submissions of the learned counsel for the petitioners and the learned counsel appearing for the respondents, W.P.

Nos.8141, 8144, 26260 and 16070 of 2023 are disposed of, -5- W.P.

Nos.2431 AND 16070 of 2023 Date of order:17.11.2025 leaving it open for the parties to adjudicate and establish their respective titles before the trial court in the civil suits.

No costs.
