THE HON’BLE SMT JUSTICE V.
SUJATHA WRIT PETITION No.2853 of 2023 ORDER: This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:- “...pleased to issue any writ, order or direction preferably a writ in the nature of Mandamus declaring the action of respondents in not protecting the State Highway road leading from Satyavedu- Srikalahasthi, admeasuring an extent of Ac.0.70 Cents in Sy.No.35 of Satyavedu Town and Mandal, Tirupati District, which is classified as road, as illegal, arbitrary and consequently direct the respondents to protect State Highway road leading from Satyavedu- Srikalahasthi admeasuring an extent of Ac.0.70 Cents in Sy.No.35 of Satyavedu Town and Mandal, Tirupati District, by not putting it to use for any purpose other than road and to pass...”.

Today, when the matter came up for admission, learned counsel for the petitioners reiterated the contentions urged in the present writ petition.

Learned Government Pleader for Roads & Buildings had produced a copy of the instructions of the 2nd respondent-Executive Engineer, vide Lr.No.WP No.2853 of 2023/encroachments/2023, dated 07.02.2023 wherein it is stated that after receiving the Writ Petition No.2853/2023, the 3rd respondent-Deputy Engineer herein has inspected the above said road and thereafter he has requested the Tahsildar i.e., 5th respondent herein to depute the surveyor for demarcation of the R&B boundaries and if any encroachments are found, to initiate necessary action as per the procedure in vogue.

In view of the said submissions of the learned Government Pleader for Roads & Buildings, this court feels it appropriate to dispose of the writ petition by directing the Tahsildar to complete the said survey as directed by the 3rd respondent-Deputy Engineer herein and to protect the State Highway road leading from Satyavedu to Srikalahasthi admeasuring an extent of Ac.0.70 cents in Sy.No. in Sy.No.35 of Satyavedu Town and Mandal, Tirupati District from encroachments.

Accordingly, with the above directions, this writ petition is disposed of.
There shall be no orders as to costs.
Consequently, miscellaneous applications, pending, if any, shall also stand closed. ____________________________________ SMT.
