JUSTICE B.S.BHANUMATHI Criminal Petition No.556 of 2023 ORDER: This Criminal Petition is filed under Section 438 Cr.P.C. to grant anticipatory bail to the petitioner/A-6 in the event of his arrest in connection with the Crime No.277 of 2022 of Akiveedu Police Station, West Godavari District registered for the offences punishable under Sections 354 A, 452, 307, 427 r/w 34 IPC.

Heard Ms M.Manikyaveena, learned counsel representing Sri Kesana Rama Koteswara Rao, learned counsel for the petitioner/A-6.

She submitted that the petitioner has been falsely implicated by the so-called confession of the co-accused and except the same which is a weak piece of evidence, there is no mention of the presence of the petitioner in the commission of the offence in the FIR which was lodged only against three persons named therein.

She further submitted that the other accused were already released on bail and that the material part of the investigation is completed, though the charge sheet is not filed.

The learned Assistant Public Prosecutor opposed the petition.

In view of the circumstances as stated by the learned counsel for the petitioner, it is a fit matter to grant anticipatory bail to the petitioner with certain conditions.

In the result, the criminal petition is allowed.

The petitioner/A.6 is directed to be released on bail in the event of his arrest in Crime No.277 of 2022 of Akiveedu Police Station, West Godavari District on furnishing personal bond for a sum of Rs.25,000/- (Rupees twenty five thousand only) with two sureties each for the like sum to the satisfaction of the Station House Officer, Akiveedu Police Station, West Godavari District, and subject to complying the following conditions: i) The petitioner/A-6 is directed to appear before the Station House Officer, Akiveedu Police Station on every Monday and Thursday between 10:00 AM and 5:00 PM until further orders or till charge sheet is filed w is filed whichever is earlier; ii) the petitioner shall be available for investigation as and when required by the Investigating Officer; iii) the petitioner shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any Investigating Officer; iv) the petitioner shall not leave the jurisdiction of the Court without the previous permission of the S.H.O. concerned; Pending miscellaneous petitions, if any, shall stand closed. _________________ B.S.BHANUMATHI, J Dt.
