SREENIVASA REDDY Criminal Petition No.2407 of 2023 Order: This Criminal Petition, under Sections 437 and 439 of Cr.P.C., has been filed by the petitioner/sole accused, seeking regular bail, in Spl.SC.No.47 of 2017 on the file of the learned I Additional District and Sessions Judge, Chittoor.

Perused the record.

A case has been registered against the petitioner in Cr.No.31 of 2017 of Panjani Police Station for the offences punishable under Sections 302 IPC and Section 3(2)(va) of the SCs and the STs (PoA) Act.
Police after conducting investigation filed charge sheet and after committal, the same is numbered as Spl.SC.No.47 of 2017 on the file of the learned I Additional District and Sessions Judge, Chittoor.
It is submitted that during the pendency of trial, on one occasion i.e., on 21.10.2022 the petitioner failed to attend the Court and due to the same, NBW has been issued against the petitioner.

It is submitted by the learned counsel for the petitioner that, the petitioner was engaged as a coolie for a period of one month at Andaman Island and in view of the same he could not attend before the Court.
On execution of NBW the petitioner was arrested on 18.01.2023 and since then he is in judicial remand.
Since the petitioner is a coolie and eking out his 2 livelihood, he could not be present before the Court on one occasion, this Court is of the opinion that ends of justice would be met if one opportunity is given to the petitioner to cooperate with the trial.

Accordingly, the Criminal Petition is allowed.
The petitioner/accused shall be released on bail on executing a personal bond for Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for the like sum to the satisfaction of the learned Additional District and Sessions Judge, Chittoor.
The petitioner shall co-operate with the trial of the case. _____________________ K.
