2093 OF 2023 ORDER: Heard.

Perused the material available on record.

The plaintiff in O.S.No.103 of 2020 is the petitioner in the present revision, filed under Article 227 of the Constitution of India.

Non-disposal of I.A.No.138 of 2020 is the grievance of the petitioner in the present revision.

The petitioner herein instituted the said suit against the respondents for declaration of his easementary right and for permanent and mandatory injunctions.

Along with the said suit, the present I.A.No.138 of 2020 came to be filed under the provisions of Order-XXXIX, Rules 1 & 2 of Code of Civil Procedure, 1908 for interim injunction.

The grievance of the petitioner, as advocated by the learned counsel for the petitioner, is that though the said application came to be filed as long back as on 28.09.2020, no orders have been passed so far and in view 2 of the same, the petitioner herein is sustaining irreparable loss and hardship.

Having heard the learned counsel for the petitioner and taking into consideration the nature of controversy, this Court deems it appropriate to dispose of the present revision, requesting the learned Principal Junior Civil Judge, Jaggaiahpet, Krishna District, to dispose of I.A.No.138 of 2020 in O.S.No.103 of 2020, as expeditiously as possible, preferably within a period of six (06) weeks from the date of the receipt of a copy of this order.

Accordingly, the Civil Revision Petition is disposed of.

No order as to costs.

As a sequel, pending miscellaneous petitions, if any, stand closed. __________________ A.V.
