THE HON’BLE SRI JUSTICE K.SREENIVASA REDDY WRIT PETITION No.4821 of 2023 ORDER:- This Writ Petition is filed under Article 226 of the Constitution of India to declare the action of respondents especially the respondent No.2 in not granting permission for using Mikes and Music Systems during Saramma Talli Tirunallu scheduled to be performed from 06.3.2023 Lingapalem Village, Lingapalem Mandal, Eluru District, Andhra Pradesh and also in not considering representation, dated 13.2.2023, submitted by the petitioners along with some other villagers as arbitrary, illegal, unconstitutional.

Heard both sides and perused the record.

At the time of hearing, the learned Government Pleader for Home, on instructions, submitted that permission is granted Vide Proceedings No.C.No.14/SDPO- J/Gen/2023, dated 26.2.2023 for conducting Saramma Goddess Tirunallu, subject to following conditions.
2 1. only box type speaker should be used.
The sound should not exceed 55 dB and 45 dB during day time and night time respectively 3.
In view of forthcoming final examinations of 10th class and Intermediate, it should not cause disturbance to the students.

Ensure that there should be no provocative speeches or create mutual hatred or cause tension between different castes and communities, religious or linguistic, which may cause disturbance to the peace and tranquility of the general public 5.
Mike shall not be played before 8.30 PM and after 10.30 PM 6.
Any type of obscene songs, dances or obscene gestures should not be allowed 7.
The proceedings should be produced on demand by any Police Officer in uniform.

Should follow the instructions given by the local police from time to time.
9.
The organizers are instructed to keep their volunteers, who are elders to administrate the total programme.

Should not obstruct free flow of traffic.

Any violation of these conditions mentioned above, the permission will automatically deem to have been cancelled and the applicant will be liable for prosecution.
Copy of proceedings dated 28.2.2023 issued by the I/c Sub-Divisional Police Officer, Jangareddigudem is placed before this Court.
Learned counsel for the petitioners submits that the same may be recorded and writ petition may be disposed of.

Recording the said submission of the learned Government Pleader that permission for usage of Mikes and Music Systems is granted subject to the above conditions, the writ petition is disposed of.
No costs.
