JUSTICE V.SUJATHA WRIT PETITION No.8953 of 2023 ORDER: This writ petition came to be filed under Article 226 of the Constitution of India, seeking the following relief: “….to issue a Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in not considering the representation of the Petitioner dated 14-02-2022 seeking to take action against the unauthorized Executive Committee of President, Vice-President, Executive Secretary, Secretary and Treasurer who is running the 5th respondent school at present with another Bye-Laws & Memorandum of Association, dated 26-11-2009 and also against the 7th Respondent for managing the affairs of the 5th respondent school without any authority is wholly illegal, arbitrary, violative of Articles 14 and 21 of the Constitution of India apart from being violative of principles of natural justice and consequently declare that the 7th respondent is not competent to manage the affairs of the 5th Respondent school….” 2.

When the writ petition came up for admission on 12.04.2023, this Court was pleased to pass the following interim order: “3.

In the mean time, the Competent Authority is directed to consider the Representation submitted by the Writ Petitioners dated 14.02.2022 (Ex.P3) and pass a Speaking Order within four (04) weeks and place a copy of the Order on the file of this Court and also furnish such Order to the Writ Petitioners forthwith.

The Writ Petitioners are directed to submit a copy of this Order along with a copy of the Representation dated 14.02.2022 (Ex.P3) to the Competent Authority within one week from today.” 3.

The respondent No.3 filed a detailed counter-affidavit, wherein it is stated that in pursuance of the interim order of this Court dated 12.04.2023, Speaking Orders in 2 Rc.No.3358/B3(B5)/2021, dated 02.05.2023, have been issued by the respondents.

In view of the same, the cause in the writ petition does not survive for further adjudication.

However, the petitioner is at liberty to file a fresh writ petition challenging the Speaking Orders dated 02.05.2023, issued by the respondents.

Accordingly, writ petition is closed.

There shall be no order as to costs.
