SREENIVASA REDDY Criminal Petition No.2698 of 2023 Order: This Criminal Petition, under Sections 437 and 439 of Cr.P.C., has been filed by the petitioner/Accused No.4, seeking regular bail, in Crime No.08 of 2022 of Nakkapalli Police Station, Visakhapatnam District.

A case has been registered against the petitioner herein and others for the offences punishable under Sections 20(b)(ii)(C) r/w 8(c) and 25 of Narcotic Drugs and Psychotropic Substances Act, 1985.

Brief facts of the case is that on 10.01.2022 at 16.30 hours, on credible information, Sub-Inspector of Police, Nakkapalli Police Station, along with his staff and mediators, went to Toll Plaza, Vempadu, and while conducting vehicle checking, found A1 to A3 in possession of 23 white plastic bags containing 900 kgs Ganja transporting the same in Eicher Van bearing No.

TN 20 R 5303.

The contraband, along with the vehicle and other materials, was seized under the cover of mediators report.

A-4 and A-5 who are involved in the crime are absconding and on 25.10.2022, A-4 was arrested.

Perused the record.

A perusal of the material on record goes to show that the petitioner was arrested on 25.10.2022 and statutory period of 180 days is not completed.

Learned Special Assistant Public Prosecutor submits that the quantity allegedly seized from the possession of the Accused is 900 kgs which is a huge quantity.

In view of the aforesaid facts and circumstances of the case, this Court is not inclined to grant regular bail to the petitioner.

Accordingly, the Criminal Petition is dismissed.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Criminal Petition, shall stand closed. _____________________ K.
