2748 of 2023 ORDER: The writ petition is filed under Article 226 of the Constitution of India for the following relief: “...to issue a Writ or Order or Direction more particularly one in the nature of Writ of Mandamus declaring the inaction of the 2nd respondent in not considering the representation dated 10.08.2022 for Compassionate Appointment as well as in not providing employment to the petitioner under compassionate grounds as being illegal, arbitrary and also oppose to all cannons of justice consequentially direct the respondents to consider the representation of the petitioner dated 10.08.2022 for Compassionate Appointment and to pass such other order or orders as this Hon’ble Court may deems fit just and proper in the circumstances of the case.” (in verbatim) 2.

Heard learned counsel for the petitioner, learned Government Pleader for Higher Education appearing for the 1st respondent and learned standing counsel for the 2nd respondent.

Learned counsel for the petitioner would submit that the prayer in the writ petition is for consideration of the petitioner’s representation dated 10.08.2022 submitted to respondent Nos.1 & 2, requesting to grant consequential benefits, i.e., pay fixation, seniority and promotion.

Learned Government Pleader for Revenue appearing for the respondents would submit that the petitioner’s representation 2 dated 10.01.2023 would be considered by respondent Nos.1 & 2 in accordance with law, within a reasonable time.

Having regard to the submissions made by learned counsel for the petitioner and in view of the submissions made by learned Government Pleader, this Court is of the considered view that the Writ Petition can be disposed of directing respondent Nos.1 & 2 to consider the petitioner’s representation dated 10.01. ted 10.01.2023 within a period of two (02) months from the date of receipt of a copy of this order, after providing an opportunity of hearing to the petitioner.

With the above said direction, the Writ Petition is disposed of.

There shall be no order as to costs.
