SREENIVASA REDDY Criminal Petition No.2672 of 2023 Order: This Criminal Petition, under Sections 437 and 439 of Cr.P.C., has been filed by the petitioner/A1, seeking regular bail, in Crime No.154 of 2023 of Rampachodavaram Police Station, East Godavari District.

A case has been registered against the petitioner and others for the offences punishable under Sections 8(c) read with 20(b)(ii)(C) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short ‘the NDPS Act’).

Case of the prosecution, in brief, is that on 06.10.2021 at about 07.00 a.m. at Pandirimamidi village centre, SH41 road, Rampachodavaram Mandal, the Sub-Inspector of Police along with his staff and mediators conducted vehicle checking, found and arrested the petitioner and others in possession of 151 Kgs of ganja covered with 04 white cement bags in TATA Safari bearing No.OR 02 AS 3562 and 89 Kgs of ganja covered with 04 white cement bags in Mahindra Bolero bearing No.AP 05 DS 2 4523.

The contraband and material objects are seized and a case was registered against the petitioner and others.

Heard the learned counsel for the petitioner and learned Special Assistant Public Prosecutor.

A perusal of material on record goes to show that, police seized 240 Kgs of Ganja from the possession of petitioner and others in the presence of mediators.

The seized quantity would amount to commercial quantity.

It is also submitted by the learned Special Assistant Public Prosecutor that investigation is at nascent stage.

Accordingly, the Criminal Petition is dismissed. _____________________ K.
