RAGHUNANDAN RAO CRIMINAL PETITION No.7 of 2023 ORDER: The petitioner is accused No.3 in Crime No.754 of 2021, on the file of the Managalagiri Rural Police Station, Guntur, for the offences under Section 420 of Indian Penal Code and Section 5 of the Andhra Pradesh Protection of Depositors of Financial Establishments Act, 1999.

The petitioner has now approached this Court, for quashing the said complaint on the ground that there are no allegations made against the petitioner in the complaint.

Manidhar Pingali, the learned counsel appearing for the petitioner would submit that the petitioner has been roped in to arm-twist his father into making payment of money in a civil dispute.

A perusal of the complaint shows that the name of the petitioner has been included in the complaint as a person who has received the money and had requested the de facto- complainant to wait for payment.

The further role of the petitioner would only be ascertained in the course of the investigation and the original complaint itself cannot be treated as encyclopaedia of facts.

In the circumstances, it would not be appropriate for this Court to intervene at this stage and it would be appropriate that the investigation in the complaint is completed.

Accordingly, the Criminal Petition is dismissed.

It is also submitted that the petitioner has already been granted bail.

In the circumstances, the Investigating Officer is directed to complete the investigation at the earliest.

Miscellaneous petitions, pending if any, in this Criminal Petition shall stand closed. ____________________________ R.
