GP FOR HOME 3 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 252 of 2023 ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “…to issue a Writ, order or a direction, more particularly one in the nature of Writ of Mandamus, declaring the action of Respondents in orally summoning the petitioner to attend the police station and pressurizing him to settle the civil disputes with third party as illegal, highhanded, arbitrary, against Law and unjust and consequently direct the respondents not to call or summon the petitioner to the police station and not to interfere with the civil disputes of the petitioner and pass.…” 2.

Heard Sri P.Vivek, learned counsel for the petitioner and Sri V.Farook, learned Assistant Government Pleader for Home for the respondents.

Learned Assistant Government Pleader for Home, on written instructions, would submit that a case in Cr.No.03 of 2023 under Sections 3(i)(r)(s) of SC/ST’s Act and Section 506 of IPC was registered against the petitioner herein on 06.01.2023.

He would further submit that the petitioner was called to the police station because a case is registered against him.

Recording the same, this Writ Petition is disposed of.

However, the police are directed to follow due process of law regarding the crime which is registered against the petitioner to secure his presence.

There shall be no order as to costs.
