SREENIVASA REDDY Criminal Petition No.2549 of 2023 Order: This Criminal Petition, under Section 438 of Cr.P.C., has been filed by the petitioner/A-2, seeking anticipatory bail, in connection with Crime No.35 of 2022 of Special Enforcement Bureau Station, Paderu, Visakhapatnam district.

A case has been registered against the petitioner herein and others for the offence punishable under Section 8(c) read with 20(b)(ii)(C) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short ‘the NDPS Act’).

Case of the prosecution is that, on 04.02.2022, at about 11.30 PM, on receipt of reliable information, the Enforcement Inspector, Special Enforcement Bureau Station, Paderu, along with his staff and mediators, while conducting vehicle checking at Konchili village junction, Hukumpeta Mandal, found the accused in possession and illegal transportation of 185 Kgs of Ganja.

Police seized the contraband, along with vehicles and other material, under cover of a mediators report and a case has been registered against the accused.

Perused the record.

The quantity of contraband allegedly seized from the possession of accused is 185 Kgs of Ganja, which is a commercial 2 quantity.

Learned Assistant Public Prosecutor submits that the investigation is at nascent stage and some more witnesses are to be examined.

In view of the aforesaid facts and circumstances of the case, this Court is not inclined to grant bail to the petitioners herein.

Accordingly, the Criminal Petition is dismissed.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Criminal Petition, shall stand closed. _____________________ K.
