RAGHUNANDAN RAO WRIT PETITION No.1223 of 2023 ORDER: The petitioner, who is in the business of establishing Telecom Infrastructure had sought to erect a ground based tower in Survey No.443 in Kanigiri Village and Mandal, Prakasam District.

However, the said tower could not be erected as the people in the locality were objecting to the establishment of the said tower.

Thereupon, the petitioner is said to have approached the 2nd respondent for Police protection for the purposes of establishing the said tower.

However, there was no response from the 2nd respondent in this regard.

The petitioner has now approached this Court, being aggrieved by the inaction of the 2nd respondent in providing Police protection to the petitioner.

Sri T.D.Phani Kumar, the learned counsel appearing for the petitioner relies upon a judgment of this Court dated 24.06.2022 in W.P.No.13280 of 2022 and a judgment dated 17.10.2022 in W.P.No.33706 of 2022 to contend that the petitioner is entitled to police protection while erecting the telecom infrastructure tower.

In view of the orders of this Court mentioned above, this Writ Petition is allowed, directing the 2nd respondent to provide Police protection to the petitioner to carry on the erection work of the ground based tower in Survey No.443 in Kanigiri Village and Mandal, Prakasam District on written request made by the petitioner to that effect.

There shall be no order as to costs.

Miscellaneous petitions, pending if any, in this Criminal Petition shall stand closed. ____________________________ R.
