THE HON’BLE SRI JUSTICE K.SREENIVASA REDDY Criminal Petition No.845 of 2023 Order: This Criminal Petition, under Section 482 Cr.P.C., has been filed on behalf of the petitioners/A1 and A2 to quash the proceedings in Crime No.4 of 2023 of Duttaluru Police Station, SPSR Nellore district, registered for the offences punishable under Sections 447, 427, 506 read with 34 IPC.

Case of the prosecution, in brief, is that, the de facto complainant sold Ac.0.90 cents of land, out of Ac.1.20 cents of his mother’s land, to A1 for Rs.83.00 Lakhs.

A1 paid some amount as advance to the de facto complainant and later he did not pay the remaining amount.

When the de facto complainant asked for the amount, A1 did not give proper answer and, subsequently, A1 and A2 trespassed into the lands of the de facto complainant and his brother- in-law and laid foundation stones without the notice of the de facto complainant.

Perused the record.

Learned counsel for the petitioners, after arguing for some time, confined his argument to the extent of providing protection to the petitioners.

Going by the material on record, there is any amount of ambiguity with regard to occupation of other land by the de facto complainant herein.

The offences alleged are all bailable ones.

In view of the aforesaid facts and circumstances of the case, this Court is not inclined to interfere with the impugned proceedings.

However, the police concerned are directed not to take any coercive steps against the petitioners herein and conduct investigation as per law.

With the above observation, the Criminal Petition is disposed of.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Criminal Petition shall stand closed. ______________________________ JUSTICE K.
