HON’BLE SRI JUSTICE R.
RAGHUNANDAN RAO WRIT PETITION No.1225 of 2023 ORDER: The petitioner who is in the business of erection and maintenance of telecom infrastructure had sought to erect a telecommunication tower in an extent of 193 Sq. yards at Dr.No.7-99/A1 in Sy.No.178 A1/B of Kandulapuram Village, Cumbum Mandal, Prakasam District.
As there was some resistance in the local area, the petitioner had sought protection from respondent No.2, in accordance with the guidelines.
As respondent No.2 was not granting such protection, the petitioner has approached this Court with the contention that this Court in similar situation in W.P.No.4375 of 2020, W.P.No.13280 of 2022 and W.P.No.33706 of 2022 had directed the Station House Officer of the area to provide police protection for erection of a telecommunication tower.
2.
The learned Assistant Government Pleader for Home, on instructions, submits that no representation of any nature was received from the petitioner.
2 3.
Be that as it may, the fact remains that the petitioner is entitled to police protection for erection of the telecommunication tower, in view of the order of this Court dated 24.06.2022 in W.P.No.13280 of 2022 and order dated 17.10.2022 in W.P.No.33706 of 2022.
There shall be a direction to the 2nd respondent to provide police protection to the petitioner to carryout erection of a telecommunication tower on the written request made by the petitioner to that effect.
4.
Accordingly, this Writ Petition is disposed of.
There shall be no order as to costs.
Miscellaneous petitions, pending if any, in this petition shall stand closed. ____________________________ R.
