SREENIVASA REDDY Criminal Petition No.1019 of 2023 Order: This Criminal Petition, under Section 482 Cr.P.C. has been filed on behalf of the petitioners/A1 and A2 to quash the proceedings in C.C.No.961 of 2019 on the file of the learned II Additional Judicial Magistrate of First Class, Nellore.

A charge sheet has been filed against the petitioners herein for the offences punishable under Sections 353, 272 and 273 read with 34 IPC.

It is represented by the learned counsel for the petitioners and acceded to, by the learned Assistant Public Prosecutor representing the respondent-State that the subject matter of this Criminal Petition is squarely covered by the common order passed by this Court in Criminal Petition Nos.5421 of 2019 and batch, dated 18.12.2019.

A perusal of the said order goes to show that the proceedings registered for the offences punishable under Sections 272 and 273 IPC as against the accused therein were quashed.
This Court is also of the same view that the offences punishable under Sections 272 and 273 IPC would not attract against the petitioners herein.
Therefore, the petitioners herein, who are similarly placed, are also entitled for 2 quashing of the proceedings only in respect of the offences punishable under Sections 272 and 273 IPC.

In view of the aforesaid facts and circumstances, the proceedings in CC No.961 of 2019 on the file of the learned II Additional Judicial Magistrate of First Class, Nellore, SPSR Nellore district, pending against the petitioners herein only in respect of the offences punishable under Sections 272 and 273 IPC are hereby quashed.
Insofar as the offence punishable under Section 353 IPC is concerned, learned Magistrate is directed to proceed with the same in accordance with law.

The Criminal Petition is, accordingly, disposed of.
As a sequel thereto, the miscellaneous petitions, if any pending, in this Criminal Petition, shall stand closed. ________________________ K. _______ K.
