THE HON’BLE MS JUSTICE B.S.BHANUMATHI Writ Petition No.9301 of 2023 ORDER: This Writ Petition is filed under Article 226 of the Constitution of India to issue a writ, order or direction more particularly one in the nature of mandamus, declaring the action of the respondent No.4 summoning the petitioner to the police station without any crime registered against the petitioner as illegal, arbitrary and amounts to abdication of statutory duties cast upon them and also violative of Articles 14, 19 and 21 of the Constitution of India and consequently direct the respondents No.2 to 4 not to interfere with the life of the petitioner and pass such other order or orders.

Heard the learned counsel for the petitioner and the learned Government Pleader for Home.

Learned counsel for the petitioner submitted that the respondent no.4 is unnecessarily calling the petitioner to come to police station.

Learned Government pleader for Home submitted that one Palli Srinu, S/o Swamynaidu gave a complaint against the sons of the petitioner i.e., Nagudu Srinivas and Nagudu Sudhakar Naidu, herein that they took money for providing a job, but they did not provide any job nor did they return the money, and that they 2 BSB, J W.P.No.9301 of 2023 threatened.
He further submitted that basing on the complaint of Srinu, the police went for enquiry to the petitioner’s house, but they were not present at the point of time, and so, on 13.04.2023, the police registered a case in Cr.No.75 of 2023 u/s 420 r/w 34 IPC at Kotananduru Police station, against the sons of the petitioner herein.
The learned Government Pleader for Home categorically submitted that the police are not interfering with the personal liberty of the petitioner and they would proceed only with the investigation in that crime.

In view of the submissions made by learned Government Pleader for Home, the writ petition is disposed of by closing the writ petition.
There shall be no order as to costs. to costs.
