THE HON’BLE MS JUSTICE B.S.BHANUMATHI Criminal Petition No.912 of 2023 ORDER: This Criminal Petition is filed under Sections 437 and 439 of the Code of Criminal Procedure, 1973 (‘Cr.P.C’), to grant bail to the petitioners/A2 and A3 in Crime No.82 of 2022 of Chinturu Police Station, East Godavari District, registered on 10.08.2022 for the offence punishable under Section 8(c) r/w 20(b)(ii)(C) of NDPS Act.

The case of the prosecution is that on 10.08.2022 when there was vehicle checking, A1 to A4 were found transporting 95 kgs of ganja in a Swift Dzire Car bearing No.
TS 11 EP 0615, but A1 and A2 escaped from the scene, whereas A3 and A4 were caught red handed and later A2 was arrested on 20.12.2022 at a bus-stand in Chinturu and was taken into Judicial Custody on 21.12.2022.

Learned counsel for the petitioners submitted that the petitioners have not committed any offence and they may be enlarged on bail.

Learned Assistant Public Prosecutor opposed the petition and submitted that charge sheet was filed on 09.02.2023.
He 2 BSB, J Crl.P.No.912 of 2023 further submitted that the petitioners hail from Telangana State.

In view of the serious offence, the petitioners cannot be granted bail.

In the result, the Criminal Petition is dismissed.
No costs.
