THE HON’BLE Ms.
JUSTICE B.S.BHANUMATHI Criminal Petition No.1736 of 2023 ORDER: This Criminal Petition is filed under Section 438 Cr.P.C. seeking anticipatory bail to the petitioner/A-6 in Crime No.60 of 2023 dated 27.02.2023 of Inavilli Police Station, Dr.B.R.Ambedkar Konaseema District, registered for the offences punishable under Sections 27(a) of NDPS Act.

Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor representing the respondent/State.

The accusation against the petitioner is that he is supplying ganja.

The learned counsel for the petitioner submitted that except the alleged confession of the co-accused, there is no evidence to implicate him in the offence.

Learned Assistant Public Prosecutor opposed the petition stating that the case against the petitioner is covered by Section 37 of the NDPS Act and he further submitted that the petitioner has criminal antecedents having been involved in five (5) other cases i.e.
1) Cr.No.97 of 2011 under Section 286, 337 r/w 34 IPC, 9B (1) (b) of Explosive Act, 1884, 2) Cr.No.50 of 2019 under Section 110 (e) Cr.P.C., 3) Cr.No.53 of 2021 under Section 110 (e) Cr.P.C., 4) Cr.No.214 of 2021 under Section 143, 148, 324, 323 r/w 149 IPC and 5) Cr.No.49 of 2023 under Section 341, 427, 423, 506 r/w 34 IPC of Ainavilli Police Station.

Since the investigation is still not completed and the petitioner is allegedly involved in several other crimes of different types of crimes as noted above, this is not a fit case to grant anticipatory bail to the petitioner/A-6 at this juncture.

In the result, the Criminal Petition is dismissed.
