1 THE HON’BLE SRI JUSTICE K.
SREENIVASA REDDY WRIT PETITION NO.3177 OF 2023 ORDER: The Writ Petition, under Article 226 of the Constitution of India, is filed seeking to declare the action of respondents 3 and 4 in interfering with petitioners’ cultivation activities and issuing directions to them not to enter their respective agricultural land in survey No.84- 18/A admeasuring Ac.0.22 cents situated in Gangampalli village, Gorantla mandal, Sri Satya Sai District as illegal and arbitrary, and consequently direct respondents 3 and 4 not to interfere with petitioners’ cultivation activities over the subject property.
It is the case of the petitioners that they inherited the subject property from their father K.Narayanappa and the revenue authorities mutated their names in revenue records assigning Katha Nos.
1091 and 1092.
It is their further case that a civil dispute arose between their family and respondent No.5, and the latter filed O.S.No.314 of 2017 on the file of the Junior Civil Judge, Penukonda seeking permanent injunction, wherein the petitioners filed written statement, and the suit is pending.
It is their grievance that without waiting for outcome of suit proceedings, respondents 3 and 4, at the behest of 2 respondent No.5, called the petitioners on 23.01.2023, 29.01.2023 and 02.02.2023 to appear before them along with all documents relating to the land, with an intimation that they have to settle the issue with respondent No.5.
Hence, the Writ Petition.
The learned Assistant Government Pleader, on instructions, submits that the official respondents are not interfering with civil disputes between the petitioners and respondent No.5.
Recording the said submission, the Writ Petition is disposed of.
No order as to costs of the Writ Petition.
