THE HON’BLE SRI JUSTICE BANDARU SYAMSUNDER TRANSFER CIVIL MISCELLANEOUS PETITION NO.202 OF 2023 ORDER: I have heard learned counsel for petitioner Mr.M.Dharma Teja.

At request of learned counsel for the petitioner, this Transfer Civil Miscellaneous Petition is disposed of at the admission stage.

This Transfer Civil Miscellaneous Petition is filed by the petitioner/wife under Section 24 of CPC seeking transfer of F.C.O.P.

No.

775 of 2022 on the file of XIV Additional District-cum- Additional Family Court, Krishna at Vijayawada to Principal Senior Civil Judge at Gudivada, Krishna District.

The petitioner is seeking transfer of the case within judicial District, though this Court has got concurrent jurisdiction under Section 24 CPC.

The learned Principal District Judge of concerned District having administration control over the Court within the District is in better position to decide the transfer petitions which are filed seeking transfer of cases within the District.

This Court observed the same vide orders passed in Tr.C.M.P.No.34 of 2023 and Tr.C.M.P.No.83 of 2023 dated 07.03.2023 and 22.06.2023 2 respectively, and also in Tr.C.M.P.No.68 of 2023 dated 08.05.2023 by following the ratio laid down by Hon’ble Division Bench of this Court in Tadikonda Surya Venkata Satyanarayana Murthy Vs.

Tammana Seetha Mahalakshmi in Tr.C.M.P.Nos.704 and 705 of 2014 order dated 21.06.2016.

In the result, this Transfer Civil Miscellaneous Petition is disposed of with a liberty to the petitioner to approach the Principal District Judge, Krishna at Machilipatnam by filing appropriate petition if she is so advised.

No order as to costs.

Consequently, miscellaneous petitions pending, if any shall stand closed.
