SURESH REDDY CRIMINAL PETITION No.5925 of 2023 ORDER: Accused No.1 in Cr.No.56 of 2023 of Thottambedu Police Station, Tirupati District, filed the present Criminal Petition, under Sections 437 & 439 of Cr.P.C., seeking his release on bail.

The above crime was registered initially under Section 174 Cr.P.C. and thereafter, it was altered to the offences punishable under Sections 120- B, 302, 201 read with Section 34 of IPC.

Without going into the merits of the case, learned counsel for the petitioner, contends that the petitioner/A.1 was arrested on 24.05.2023 and even after completion of the statutory period of 90 days from the date of remand, the charge sheet is not filed by the police and as such, the petitioner is entitled for bail.

On the other hand, learned Assistant Public Prosecutor, on instructions, confirms that the police have not filed the charge sheet in the above crime even after completion of 90 days.

In that view of the matter, as the police have not filed the charge sheet within the statutory period of 90 days, this Court is inclined to grant bail to the petitioner/A.1, with certain conditions. (i) The petitioner/A.1 is directed to be released on bail on his furnishing a personal bond for a sum of Rs.20,000/- (Rupees twenty thousand only) with two sureties for the like sum each to the satisfaction of the Principal Junior Civil Judge cum Judicial Magistrate of I Class, Srikalahasthi. (ii) On release, the petitioner shall appear before the Station House Officer concerned, on every Sunday between 10.00 a.m. and 01.00 p.m., until further orders. (iii) Further, the petitioner is directed not to hamper the investigation and tamper with the prosecution witnesses.
