THE HON’BLE SRI JUSTICE RAVI CHEEMALAPATI WRIT PETITION NO.20430 OF 2023 ORDER: The present writ petition is filed seeking the following relief: “.....declaring the action of the respondent nos.1 to 5 in not releasing of the sanctioned amount Rs.10 lakhs for financial assistance of my daughter REDDY BHAGYA LAKSHMI PRASANNA to study her master degree in Masters in Data Science at ‘Indiana University Bloomington’ in United States of America, under the scheme of VIDESHI VIDYA DEEVENA Application ID No.OV2018121463 as illegal, arbitrary and unjust contrary to law and in violation of Article 14, 19, 21 of Constitution of India and principles of Natural Justice ....” 2.

Heard Sri Peddi Vijay Bhaskhar, learned counsel for the petitioner, learned Assistant Government Pleader for Finance and Planning and learned Government Pleader for Social Welfare.

Learned Government Pleader for Social Welfare on written instructions dated 05.05.2023 submitted that, in the enquiry conducted by the Vigilance Department the petitioner’s daughter was found eligible and entitled for extending the benefit ‘Videshi Vidya Deevena’, as such the authorities have admitted to release/pay the sanctioned amount to the candidate and sought three (03) months time for payment of the amount.

The learned Government Pleader further submitted that the 1st respondent is not a necessary party to the proceedings.

To the said submission, learned counsel for the petitioner submitted that 6th respondent, who is necessary party was added as per orders of this Court dated 13.09.2023 passed in I.A.No.2 of 2023 and reported no objection for granting time sought by the learned Government Pleader.

A perusal of the written instructions shows that, the petitioner’s daughter was found eligible under ‘Vidheshi Vidhya Deevena’ and entitled for the sanction of amount, in the Vigilance Enquiry. e Enquiry.

As the respondent authorities are also ready to release the sanctioned amount to the petitioner’s daughter as she was found eligible, instead of keeping this writ petition pending, this Court is inclined to dispose of the same with the following direction: The respondents are directed to release the sanctioned amount to the petitioner at the earliest, and at any rate, within a period of three (03) months from the date of receipt of copy of this order.

Accordingly, the writ petition is disposed of.

No costs.
