THE HON’BLE SRI JUSTICE RAVI CHEEMALAPATI WRIT PETITION NO.20225 OF 2023 ORDER: The present Writ Petition is filed by the petitioner under Article 226 of the Constitution of India, seeking the following relief: “….to issue a writ, order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of respondents in noncompliance of funds with the M-Book No (i) M.Book No.6797-A for construction of drain at Kotachambagiri (from Subrahmanyam house to MPP School), providing pipeline to Rajamma house to lakshmamma house, providing new panel board to the RWS Scheme pumpset repairs to PWS scheme of Kuppuganipalle Village, Gudupalli Mandal, Chittoor District under 14th finance commission funds at Kotachambagiri of Kuppuganipalle village of Gudupalli Mandal in Chittor district as illegal, irregular, arbitrary and violative of Articles 14, 21 and 300A of Constitution of India and consequently direct the respondents to pay the amounts with interest as per the aforesaid Measurement Book Numbers under the 14th finance commission funds forthwith to the petitioner and pass such other order or orders as this Hon’ble Court may deem fit and proper in the circumstances of the case……” 2.

When the matter is taken up for consideration today, Sri G.
Venkata Reddy, learned Standing Counsel on written instructions dated 25.08.2023, submitted that, the outstanding amount will be paid to the petitioner, and however, sought three (03) months time for such payment.

To the said submission, learned counsel for the petitioner submitted that, the amount involved is small amount, three (03) months time is too long, as such, prayed to give reasonable time for payment.

Taking into consideration the submissions of both the learned counsel, as the authorities are willing to pay the legally entitled amount to the petitioner, there is no purpose in keeping the Writ Petition pending, this Writ Petition is also disposed of, at the admission stage.
Accordingly, the respondents are directed to release the legally entitled amount to the petitioner at the earliest, and at any rate, within a period of three (03) weeks from the date of receipt of a copy of this order.
There shall be no orders as to costs.
