With the consent of both the counsel, the writ petition is disposed of, at the stage of admission.

The present writ petition is filed aggrieved by the action of the 3rd respondent in seizing the vehicle of the petitioner in connection with an excise offence vide order No.29/CO/SEB/NDL/2023, dated 05.4.2023 and non disposal of the appeal dt.24.7.2023 filed against the said order, as illegal, arbitrary, and for a consequential direction 2 to the 2nd respondent to dispose of the appeal within a stipulated time.

Though the learned counsel for the petitioner sought to advance arguments, with reference to merits of the case, as it is for the 2nd respondent/appellate authority to consider the same, this Court is not inclined to go into the said aspects.

Therefore, the writ petition is disposed of, with a direction to the 2nd respondent to pass appropriate orders in the appeal dated 24.7.2023, strictly in accordance with law, as expeditiously as possible, at any rate, within a period of three (3) weeks from the date of receipt of a copy of this order, if not already passed.

No order as to costs.
