SURESH REDDY CRIMINAL PETITION No.

5816 OF 2023 ORDER: Accused No.11 in Crime No.95 of 2023 on the file of Nandyal III Town Police Station, Kurnool District filed the present application under Section 438 of the Criminal Procedure Code, 1973, seeking anticipatory bail.

The said crime was registered for the offences punishable under Section 370-A(2) of IPC and Sections 4, 5, 6 & 7 of the Immoral Traffic (Prevention) Act, 1956.

The case of the prosecution is that the petitioner is the owner of CPR Grand Lodge situated at Nandyal Town.

On credible information, the Inspector of Police, Nandyal III Town Police Station raided the said lodge and found some of the persons doing prostitute business in room Nos.2101 and 2102.

The Inspector of Police, after conducting panchanama, arrested the accused who were found there.

The allegation made against the petitioner is that he is the owner of the said lodge and he allowed Accused Nos.7 to 10 to do prostitution business in his lodge in the above two rooms.

Learned counsel for the petitioner contends that the petitioner is not the owner of the said lodge and he is the employee in the said lodge.

As such, he requested this Court to grant anticipatory bail to the petitioner.

On the other hand, learned Special Assistant Public Prosecutor states that the entire episode was done with the knowledge of the petitioner, who is the owner of CPR Grand Lodge.

Be that as it may, this Court is not inclined to grant anticipatory bail to the petitioner in view of the specific averment that he is the owner of the said lodge.
