1 THE HON’BLE SRI JUSTICE RAVI CHEEMALAPATI WRIT PETITION No.19832 of 2023 ORDER: This Writ Petition is filed by the petitioner, under Article 226 of the Constitution of India, seeking the following relief: “….to issue an appropriate Writ, Order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in not releasing the final bill amount of Rs.2,94,882/- to the petitioner including interest for the work providing CC road from Ramalayam to maridithalligudi at Pedagangavaram in Zeenabadu panchayat of ananthagiri mandal in pursuance of agreement with the 5th respondent vide agreement on 2018-19 dated 16.02.2019 as being illegal, irregular, arbitrary and consequently direct the respondents to pay undisputed final bill amount of Rs.2,94,882/- to the petitioner including interest for the work providing CC road from Ramalayam to maridithalligudi at Pedagangavaram in Zeenabadu panchayat of ananthagiri mandal in pursuance of agreement with the 5th respondent vide agreement on 2018-19 dated 16.02.2019 and pass such other order or orders….” 2.

G.Prasanthi, learned counsel for the petitioner, learned Assistant Government Pleader for Panchayat Raj Department appearing for respondent Nos.1,3 to 6, learned Assistant Government Pleader for Finance Department appearing for respondent No.2 and Sri G.Venkata Reddy, learned standing counsel appearing for respondent nos.7 to 9.

On the last occasion, when the matter is listed on 23.8.2023, learned Assistant Government Pleader for Panchayat Raj Department, on instructions, submitted that the authorities are ready to pay the legally entitled amount of Rs.2,72,820/- 2 (Rupees two lakhs seventy two thousand eight hundred and twenty only) as against the claim made by the petitioner to a tune of Rs.2,94,882/- and accordingly the petitioner sought time to get instructions. tructions.
Today when the matter is taken up for consideration, learned counsel for the petitioner submitted that the petitioner is ready and willing to accept Rs.2,72,820/- (Rupees two lakhs seventy two thousand eight hundred and twenty only).
To the said submission, learned Assistant Government Pleader sought three (3) weeks time may be granted for payment and to the said submission, learned counsel for the petitioner reported no objection.

In view of the above, as the respondent authorities are ready and willing to pay the legally entitled amount to the petitioner, there is no purpose in keeping the writ petition pending.
As such, this Court is inclined to dispose of the writ petition with the following directions.

Accordingly, the respondent authorities are directed to release the legally entitled amount of Rs.2,72,820/- (Rupees two lakhs seventy two thousand eight hundred and twenty only) to the petitioner, within a period of three (3) weeks from the date of receipt of a copy of this order.

With the above directions, the writ petition is disposed of.
There shall be no order as to costs.
