G V S KISHORE KUMAR The Court made the following: THE HON’BLE SRI JUSTICE VENKATESWARLU NIMMAGADDA CONTEMPT CASE NO: 4180/2023 ORDER This contempt case is filed against the respondents for willful disobedience of the orders dated 18.04.2023 passed by this Court in W.P.No.9538 of 2023.
Heard the learned counsel for the petitioners and the learned Standing Counsel for the respondents.
Learned counsel for the petitioners submits that even though this Court specifically directed the respondents to consider the representation of the petitioner and pass appropriate orders, the respondents have passed the orders reiterating the earlier proceedings as if the present representation is disposed of.
Hence, the respondents have committed default in compliance of the orders of this Court.
On the other hand, learned Standing Counsel for respondent No.2 filed counter-affidavit, wherein it is stated that orders of this Court have been complied with in all respects and representation of the petitioner was considered as per G.O.Ms.No.179.
It is further stated that since, the petitioners were appointed after 01.09.2004, as per G.O.Ms.No.179, the petitioners are not eligible for old pension scheme.
The respondents also quoted that the Andhra Pradesh Revised Pension Rules are not at all applicable to the persons who are appointed after 01.09.2004.

Having regard to the submissions made by both the learned counsel, this Court cannot be construed that there is any default/non-compliance of the orders of this Court on behalf of the respondents.
Therefore, the orders of this Court are complied with, no further orders are necessary.
Accordingly, the Contempt Case is closed.
However, the petitioners are at liberty to challenge the fresh proceedings dated 26.09.2023 issued in compliance of the orders of this Court.
No order as to costs.
