SREENIVASA REDDY CRIMINAL PETITION No.5585 of 2023 Order: This Criminal Petition, under Section 482 of the Code of Criminal Procedure, 1973, is filed on behalf of the petitioner/A4 to quash the proceedings in SC No.460 of 2019 on the file of learned Additional Senior Civil Judge-cum-Fast Track Court, Badvel.

A charge sheet was filed against the petitioner herein and others for the offences punishable under Sections 147, 148, 324, 326, 307 read with 149 IPC, arising out of Crime No.45 of 2016 of B.
Kodur Police Station.
Since the offence punishable under Section 307 IPC is exclusively triable by the Court of Sessions, the case was committed to the Court of Sessions and the same was numbered as SC No.460 of 2019 on the file of learned Additional Senior Civil Judge-cum-Fast Track Court, Badvel.

The grievance of the petitioner herein is that he used to work in Kuwait and because of filing the present false case against him, he was forced to come back to India, thereafter, he lost his employment and residing in India without there being any employment.

Learned counsel for the petitioner, after arguing for some time, has confined his argument to the extent of directing the Court below for early disposal of SC No.460 of 2019.

In view of the aforesaid facts and circumstances of the case, without going into the merits of the case, learned Additional Senior Civil Judge-cum-Fast Track Court, Badvel, is directed to dispose of SC No.460 of 2019, in accordance with law, as expeditiously as possible, preferably within a period of six (6) months from the date of receipt of a copy of this order.

With the above direction, the Criminal Petition is disposed of.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Criminal Petition, shall stand closed. __________________________ JUSTICE K.
