1 THE HON’BLE SRI JUSTICE K.SREENIVASA REDDY CRIMINAL PETITION NO.5605 of 2023 ORDER:- This Criminal Petition under Section 482 of the Code of Criminal Procedure, 1973 (for short “Cr.P.C.”) is filed by A1 to A5, to quash the Proceedings in Crime No.123 of 2023 of Disha PUPS, Guntur, Guntur District, registered for the offences punishable under Sections 498-A, 506 of the Indian Penal Code, 1860 and under Sections 3 and 4 of the Dowry Prohibition Act.

Learned counsel for the petitioners/A1 to A5, after arguing for some time, has confined his argument to the extent of protecting the petitioners herein from the coercive action by the police.

On the other hand, learned Assistant Public Prosecutor contended that specific accusations have been made as against the petitioners herein and truth or otherwise of the said accusations has to be gone into by the investigating agency.

Perused the record.

Since truth or otherwise of accusations that have been made in the FIR as against the petitioners herein can be gone into, by the investigating agency, this Court, in a petition filed under Section 482 Cr.P.C., would not be in a position to go into 2 the disputed questions of fact and quash the proceedings at this stage.

In view of the aforesaid facts and circumstances of the case, this Court is not inclined to quash the proceedings against the petitioners herein.
However, the police concerned are directed to conduct investigation without taking any coercive steps against the petitioners herein/A-1 to A5.

With the above observation, the Criminal Petition is disposed of.
