THE HON’BLE SRI JUSTICE RAVI CHEEMALAPATI WRIT PETITION NO.19392 OF 2023 ORDER: The present Writ Petition is filed by the petitioner under Article 226 of the Constitution of India, seeking the following relief: “….to issue a writ of mandamus or any other appropriate writ or direction declaring the action of the Respondents not releasing the deposit amounts as Rs.23,011/- vide M Book No.625-C, Rs.22,543/- vide M Book No.7591-B, Rs.23,095/- vide M Book No.7589-B, Rs.22,417/- vide M Book No.7599-B & Rs.23,292/- vide M Book No 629-C even after completion of defect liability period refund payable to the petitioner in relation to the works i e Construction of CC roads and underground drainage works in Kaligiri Gram Panchayat of Kaligiri Mandal of SPSR Nellore District under MGNREGS Convergence Grant is questioned as the same is illegal arbitrary and consequently direct the respondents to release the deposit amounts as Rs.23,011/- vide M Book No,625-C, Rs.22,543/- vide M Book No.7591-B, Rs.23.095/- vide M Book No.7589-B, Rs.22,417/- vide M Book No.7599-B & Rs.23,292/- vide M Book No.629-C to the petitioner in respect of abovementioned work forthwith and pass such other or further orders as the Hon’ble Court feels deem fit and proper in the facts and circumstances of the case.....” 2.

Heard Sri Bathala Ramesh, learned counsel for the petitioner and learned Assistant Government for Panchayat Raj.

When the matter is taken up for consideration today, the learned Assistant Government for Panchayat Raj, based on the written instructions dated 09.08.2023, submitted that, the authorities are ready to pay the petitioner’s legally entitled amount 2 of Rs.1,14,358/- and sought two (02) weeks time to pay the said amount.

To the said submission, learned counsel for the petitioner reported no objection.

Taking into consideration the submissions of both the learned counsel with their consent, this Writ Petition is disposed of, with the following direction: “The respondents are directed to release the admitted/legally entitled amount to the petitioner, within a period of two (02) weeks from the date of receipt of a copy of this order”.

Accordingly, the Writ Petition if disposed of.

There shall be no orders as to costs.
