SRINIVASA RAO BODDULURI The Court made the following: ORDER: This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:- “….to issue an appropriate writ more in the nature of Writ of Mandamus challenging the action of the 2nd Respondent in issuing the Notifications dated 02.02.2023 and 08.02.2023 vide Reference Nos.14- 56/2022-PCI (Approval Process for 2022-23 a.s)/ 17462-64 and 14-56/2022-PCI (Approval Process for 2022-23 a.s/17710 respectively issued by Respondent No.2, namely the Pharmacy Council of India, and the consequential circular vide Ref No.14- 56/2023 (Approval process for 2023-24 a.s) (E)/2540, 26.07.2023 whereby and whereunder the 2nd Respondent Pharmacy Council of India is insisting for payment of exorbitant amount towards Security Deposit from the Institutions imparting Pharmacy Courses and further in enhancing the Pharma Education Regulatory Charges by about 100% and for Pharma-D about 600% from the existing charges without any rationale or reason as being illegal, arbitrary violating Articles 14 & 19 (1) (g) of the Constitution of India apart from being in contravention of the Pharmacy Act or the Regulation framed thereunder and also in violation of the guidelines of the Pharmacy Council of India apart from being in contravention of the Pharmacy Act or the Regulation framed thereunder and also in violation of the guidelines of the Pharmacy Council of India and consequently set aside the....” 2. he....” 2.

When the matter came up for admission on 07.08.2023, this Court passed the following interim order: “….In view of the facts and circumstances, once this Hon’ble Court granted interim suspension in respect of notifications dated 02.02.2023 and 08.02.2023, the respondents cannot be permitted to issue the impugned proceedings by reiterating the same.

As such, there shall be an interim suspension of the impugned circular/proceedings dated 26.07.2023.” 3.

Learned counsel for the petitioner submitted that in pursuance of the interim order dated 07.08.2023 granted by this Court, the cause in the writ petition does not survive.

Recording the above submission, the cause in the writ petition does not survive for further adjudication.

Accordingly, the Writ Petition is closed.

There shall be no order as to costs.
