THE HONOURABLE SMT JUSTICE V.

SUJATHA WRIT PETITION No.19095 of 2023 ORDER:- Today when the writ petition is came up for hearing, learned Government Pleader for school Education has produced a copy of instructions vide Rc.No.Spl/A2/2023, dated 02.08.2023, of the 4th respondent, wherein it is stated that the petitioner requested to transfer him to any one of the SA (Biology) vacancies at Government Queen Mary Girls High School, Visakhapatnam, Government High School, Railway Colony, Visakhapatnam or Government High School, Yellamanchili.

The request of the petitioner could not be considered as there are no vacancies for the SA (Biology) post in the said schools.

It is stated in the relevant paragraphs of the said instructions as follows: “In this connection, I submit that all vacancies along with re-opened surplus vacancies are notified in web counseling at the time of counseling and all the vacancies are notified as per the guidelines issued in the reference 6th cited and the individual was posted at Govt.

High School, Killoguda, Dumbriguda Mandal, erstwhile Visakhapatnam as per his eligibility and basing on the options exercised by him.

2 Further I submit that the individual has submitted the representation dated 17.06.2023 i.e., after completion of the transfers counseling the allotment of orders in web portal as per his eligibility.

Hence it is not feasible to consider the representation of the individual to modify the transfer orders issued in online as per his eligibility.” 2.

However, learned counsel for the petitioner has stated that at the time of choosing web options, the place of Government High School, Devarapalli was not shown vacant for the petitioner as the said post is shifted under reapportionment.

The 4th respondent reallotted the said post as vacant and made it available.

As the petitioner applied for transfer, there is no option left over to him.

In view of the same, the petitioner made a representation, dated 17.06. ted 17.06.2023 requesting to consider his case for transfer and to give an opportunity to work in Government High School, Devarapalli, Visakhapatnam and also to retain him in the reapportionment vacancy.

In view of the submissions made by the learned counsel for the petitioner and the learned Government Pleader, this Court deems it appropriate to dispose of the writ petition, without going into merits of the case, directing the 3rd 3 respondent to consider the representation, dated 17.06.2023 made by the petitioner and pass appropriate orders within a period of two weeks from the date of receipt of a copy of this order.

Accordingly, the Writ Petition is disposed of.

There shall be no order as to costs.

Miscellaneous petitions pending, if any, in this writ petition shall stand closed. _______________________ SMT JUSTICE V.
