HARERA vs MUNJAL HOSPITALITY LIMITED

Adv. Amrita Tonk (Advocate) appeared on behalf of the promoter. The counsel for the promoter has filed the reply along with affidavit and states that the project is still under construction and no third-party rights have been created till date and further states that as per affidavit filed by the promoter, they are planning to execute lease for 3-5 years. However, while considering the reply of the promoter, authority is of the view that if at any point of time in future, it is observed or found that any unit is sold, or long-term lease have been executed i.e., beyond 5 years then the promoter shall be bound to get their project register and pay the deficit or late fees as applicable as per RERA norms. Hence, the proceedings of Suo motu is disposed of.
