The complainant has filed an application for rectification dated 04.05.2023 regarding rectification in the detailed order dated 09.07.2021. The above-mentioned matter was heard and disposed off. vide order dated 09.07.2021, wherein the Authority had directed the respondent to pay the delayed possession charges at the prescribed rate i.e., 9.30% for every month of delay on the amount paid by the complainant from the due date of possession i.e., 14.11.2017 plus two months which comes out to be 14.01.2018. The counsel for the respondent states that the matter is under settlement and settlement agreement is under signature and is not yet signed. Therefore, it is hereby clarified that besides payment of delayed possession interest in terms of the above order, the respondent is required to hand over the physical possession of the unit after obtaining of occupation certificate/CC/part CC from the competent authority and thereafter, the complainant is obligated to take the possession within 2 months as per Section 19 (10) of the Act, 2016. In view of the above, the application stands disposed off. File be consigned to the registry. The said orders may be read as part of the main orders dated 9.7.2021. Matter stands disposed off.
