LAKHBIR MAHAJAN vs MGF DEVELOPMENT LIMITED

The parties have arrived at an amicable settlement and a settlement agreement dated 07.01.2023 to this effect has been placed on record duly signed by both the parties. In view of above settlement agreement,  the present complaint stands disposed off. File be consigned to the registry.

The present complaint was filed on 02.03.2022 and registered as complaint no. 795 of 2022. On the last date of hearing, none appeared on behalf of  respondent appeared but the counsel for complainant stated that settlement talks were going on. The counsels were directed to submit either the settlement deed or reply but neither have been submitted till date. The counsel for the respondent states on instructions from the respondent that  the matter is under settlement and settlement deed/MoU has been sent to the complainant for signing. On the other hand, counsel for the complainant states that no such settlement deed/proposal has been received in the matter. The respondents are directed to submit copy of settlement deed or reply within a period of two weeks i.e. by 21.11.2022  in the registry  with a copy to the complainant failing which a cost of Rs.10,000/- would be imposed. Matter to come up on  03.03.2023  for further proceedings.

On the last date of hearing Mr. Harinder Singh Chauhan Advocate has appeared from the respondent side and filed power of attorney. The counsel for the respondent requested an adjournment for filling reply and the same was allowed by directing the respondent to file reply within 2 weeks but the respondent has failed to file reply even on this date. The proxy counsel for the respondent has stated at bar that settlement talks  in progress and seeks a short adjournment. Request is allowed. The respondent is directed to file  settlement deed failing which reply shall be filed  within four weeks i.e. by 02.09.2022 in the registry with a copy to the complainant. Last opportunity is being granted. Matter to come up on 07.11.2022 for further proceedings.
