    This is an application with request to revive execution petition. It is submitted by learned counsel for applicant/DH that JD had filed appeal against order/decree under execution, same has been disposed of by the Appellate Tribunal vide order dated 12.10.2022. Copy of such an order has been put on file.                           In view of order passed by the Appellate Tribunal, execution petition is thus revived.                           At the same time, learned counsel for DH requests for direction to the Accounts Officer of the authority to release amount in his favour.                          Learned counsel took me through order of the Tribunal. After dismissing appeal filed by JD, the Tribunal was pleased to direct that the amount of Rs. 16,54,720/- deposited by Appellant-promoter with the Tribunal as pre-deposit, to comply with the provisions of Section 43(5) of the Act, alongwith interest accrued thereon, be sent to the learned authority for disbursement to the respondents-allottees subject to tax liability.                         Learned counsel undertakes that if there is any tax liability, his client is liable to pay. Considering said fact, request is allowed. Accounts Officer of the authority is directed to disburse said amount in favour of DH, as per order of Tribunal.                       Report of Accounts Officer be called till next date.                         To come on 10.04.2023 for further proceedings.
