DHEERAJ SARRAJU AND USHA SARRAJU vs SELENE CONSTRUCTION LTD

It is pointed out that parties have settled their dispute. A sum of Rs. 18,14,418/- has already been received by the DH. All this is accepted by learned counsel for the latter (DH). She requests to dispose of the execution petition stating that decree has already been satisfied.                          Statement of learned counsel for DH is recorded separately.                          Keeping in view of aforesaid facts execution petition is disposed of, decree having been satisfied.                           File be consigned to the records.

File put up today, on an application filed by DH, with a prayer to revive execution petition. It is submitted by learned counsel for applicant/DH, that special leave petition filed before Apex Court has been disposed of, vide order dated on 11.05.2022.  By order of the Authority dated 23.02.2021, the execution petition was adjourned sine die, awaiting outcome of SLP described above.                   It is pointed out that the authority on 03.02.2021, allowed request of JD to make payment within 15 days. According to learned counsel for DH, no such payment is made till now. Learned counsel requests for direction to JD to disclose its assets/properties which can be attached to realize decretal amount, stating that his client (DH) has no information about such assets/properties.                  Request is allowed JD is directed to disclose its assets/properties including details to bank account till next date. Information be given in the forum of affidavit, to be sworn by anyone from the directors preferably by the managing director. Copies of title deeds and statement of bank account be also provided along with the affidavit.                     To come on 03.02.2023 for further proceedings.
